class=\"wp-block-heading\">\u5546\u6a19\u4fdd\u8b77\u306e\u4ed5\u7d44\u307f<\/h3>\n\n\n\n<p>\u7c73\u56fd\u306b\u304a\u3051\u308b\u5546\u6a19\u4fdd\u8b77\u306e\u4ed5\u7d44\u307f\u306f\u3001<strong>\u30b3\u30e2\u30f3\u30ed\u30fc<\/strong>\u3001\u5404\u5dde\u304c\u72ec\u81ea\u3067\u5236\u5b9a\u3059\u308b<strong>\u5dde\u6cd5<\/strong>\u3068<strong>\u9023\u90a6\u6cd5<\/strong>\u306b\u3088\u308b\u4fdd\u8b77\u306e\u591a\u91cd\u69cb\u9020\u3068\u306a\u3063\u3066\u3044\u307e\u3059\u3002<br><br><br><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u30b3\u30e2\u30f3\u30ed\u30fc(Common Law)\u306b\u3088\u308b\u4fdd\u8b77<\/h4>\n\n\n\n<p>\u7c73\u56fd\u5185\u3067\u5546\u6a19\u3092\u4f7f\u7528\u3059\u308b\u3068\u767b\u9332\u3059\u308b\u3053\u3068\u306a\u304f\u5f53\u7136\u306b<strong>\u30b3\u30e2\u30f3\u30ed\u30fc<\/strong>\u306b\u3088\u308a\u5546\u6a19\u6a29\u304c\u767a\u751f\u3057\u307e\u3059\u3002<strong>\u30b3\u30e2\u30f3\u30ed\u30fc<\/strong>\u3068\u306f \u88c1\u5224\u6240\u304c\u4f1d\u7d71\u3084\u6163\u7fd2\u3001\u5148\u4f8b\u306b\u57fa\u3065\u304d\u5224\u6c7a\u3057\u3066\u84c4\u7a4d\u3055\u308c\u78ba\u7acb\u3055\u308c\u305f\u5224\u4f8b\u6cd5\u3084\u4e0d\u6587\u6cd5\u306e\u3053\u3068\u3067\u3059\u3002<\/p>\n\n\n\n<p><strong>\u30b3\u30e2\u30f3\u30ed\u30fc<\/strong>\u306b\u3088\u308b\u5546\u6a19\u6a29\u306e\u4fdd\u8b77\u7bc4\u56f2\u306f\u4f7f\u7528\u306b\u3088\u308a\u8a8d\u77e5\u3055\u308c\u3066\u3044\u308b\u5730\u57df\u3001\u3059\u306a\u308f\u3061\u3001<strong>\u51fa\u6240\u6df7\u540c\u3092\u751f\u3058\u308b\u5730\u57df\u306b\u9650\u3089\u308c<\/strong>\u307e\u3059\u3002<br><br>\u307e\u305f\u3001\u8a34\u8a1f\u306a\u3069\u3067\u5546\u6a19\u6a29\u3092\u6709\u3059\u308b\u65e8\u306e\u7acb\u8a3c\u306f\u5546\u6a19\u6a29\u8005\u304c\u3059\u308b\u5fc5\u8981\u304c\u3042\u308a\u307e\u3059\u3002<br><br><br><\/p>\n\n\n\n<h4 class=\"wp-block-heading\">\u5dde\u6cd5\u306b\u3088\u308b\u4fdd\u8b77<\/h4>\n\n\n\n<p>\u7c73\u56fd\u306e\u3042\u308b\u7279\u5b9a\u306e\u5dde\u3060\u3051\u3067\u4fdd\u8b77\u3092\u53d7\u3051\u305f\u3044\u5834\u5408\u306f\u3001\u5dde\u6cd5\u306b\u3088\u308b\u767b\u9332\u3092\u53d7\u3051\u308b\u3053\u3068\u3082\u3067\u304d\u307e\u3059\u304c\u3001\u65e5\u672c\u304b\u3089\u306e\u5546\u6a19\u767b\u9332\u51fa\u9858\u3067\u306f\u3001\u3053\u306e\u767b\u9332\u306b\u3088\u308b\u4fdd\u8b77\u306f\u3042\u307e\u308a\u610f\u5473\u3092\u306a\u3055\u306a\u3044\u3067\u3057\u3087\u3046\u3002<br><br><br><\/p>\n\n\n\n<h4 Act)\u306b\u3088\u308b\u4fdd\u8b77<\/h4>\n\n\n\n<p>\u30e9\u30f3\u30cf\u30e0\u6cd5\u306b\u3088\u308a\u5546\u6a19\u51fa\u9858\u3092\u3057\u3001\u9023\u90a6\u767b\u9332\u3055\u308c\u308b\u3068\u3001\u30b3\u30e2\u30f3\u30ed\u30fc\u306b\u3088\u308b\u5148\u4f7f\u7528\u8005\u306f\u3001\u305d\u306e\u5546\u6a19\u3092\u4f7f\u7528\u3059\u308b\u3053\u3068\u306f\u3067\u304d\u307e\u3059\u304c\u3001\u3082\u306f\u3084<strong>\u4fdd\u8b77\u7bc4\u56f2\u306e\u62e1\u5f35<\/strong>\u304c\u3067\u304d\u306a\u304f\u306a\u308a\u307e\u3059\u3002<\/p>\n\n\n\n<p>\u307e\u305f\u3001\u9023\u90a6\u767b\u9332\u306b\u306f\u4ee5\u4e0b\u306e\u3088\u3046\u306a\u30e1\u30ea\u30c3\u30c8\u304c\u3042\u308a\u307e\u3059\u3002<\/p>\n\n\n\n<p>\u25a0\u7c73\u56fd\u5168\u57df\u3078\u9023\u90a6\u767b\u9332\u306e\u6a29\u5229\u8005\u306e\u5546\u6a19\u6a29\u304c\u5b58\u5728\u3059\u308b\u3053\u3068\u306b\u3064\u3044\u3066\u3001\u901a\u77e5\u304c\u306a\u3055\u308c\u305f\u3082\u306e\u3068\u307f\u306a\u3055\u308c\u3001<strong>\u5584\u610f\u306e\u6297\u5f01(good faith defense) <\/strong>\u304c\u3067\u304d\u306a\u304f\u306a\u308b\u3002<\/p>\n\n\n\n<p>\u25a0 \u4e00\u90e8\u306e\u5730\u57df\u3067\u3057\u304b\u4f7f\u7528\u3057\u3066\u3044\u306a\u304f\u3066\u3082\u51fa\u9858\u65e5\u306b\u304a\u3044\u3066\u5168\u7c73\u3067\u51fa\u9858\u5546\u6a19\u306e\u4f7f\u7528\u3092\u3057\u305f\u3068\u307f\u306a\u3055\u308c\u308b\u3002<\/p>\n\n\n\n<p>\u25a0 \u9023\u90a6\u767b\u9332\u3092\u53d7\u3051\u305f\u5546\u6a19\u3092\u7a0e\u95a2\u306b\u7533\u8acb\u3059\u308b\u3053\u3068\u306b\u3088\u308a\u3001 Use)\u306b\u57fa\u3065\u304f\u51fa\u9858<\/h4>\n\n\n\n<p>\u9858\u66f8\u3067\u51fa\u9858\u5546\u6a19\u3092<strong>\u4f7f\u7528\u3059\u308b\u8aa0\u5b9f\u306a\u610f\u601d (Bona Fide Intention to Use the<br> Mark)<\/strong>\u3092\u5ba3\u8a93\u3057\u3066\u51fa\u9858\u3057\u307e\u3059\u3002<\/p>\n\n\n\n<p>\u3059\u306a\u308f\u3061\u3001\u6570\u5e74\u7a0b\u5ea6\u3067\u73fe\u5b9f\u306b\u305d\u306e\u5546\u6a19\u3092\u4f7f\u7528\u3059\u308b\u610f\u601d product, or the totality of the elements, and &#8220;may include features such as size, shape, color or color combinations, texture,
